Michigan Legislature Codifies Michigan Supreme Court Ruling in Rouch World, LLC v. Department of Civil Rights

As previously reported, the Michigan Supreme Court in Rouch World, LLC v Department of Civil Rights, No. 162482,    Mich      NW2d    (July 28, 2022), ruled that discrimination based on sex under the Michigan Elliott Larsen-Civil Rights Act (“ELCRA”) includes discrimination based on sexual orientation and gender identity.  In turn, the Michigan legislature has now amended ELCRA to codify this ruling and expands that decision to include protections for gender identity and gender expression. The amendment will allow individuals to file such discrimination complaints with the Michigan Department of Civil Rights in employment, housing, education, and access to public accommodations contexts.
