Segal McCambridge Secures Favorable Pre-Trial Resolution in Texas Trucking Case

Segal McCambridge Shareholder Kenneth Williams secured a favorable resolution on behalf of a trucking company in a Texas personal injury action, resolving the matter on defense terms immediately before jury selection.

The lawsuit stemmed from a July 29, 2020 accident in Houston involving two pedestrians who alleged they were struck while crossing the street. Plaintiffs sought damages for alleged serious and permanent injuries, including past and future medical expenses, pain and suffering, physical impairment, disfigurement, lost wages and loss of earning capacity.

Kenneth was brought in as lead trial counsel shortly before trial. With a dispositive motion on liability already denied, the defense focused on presenting a compelling trial strategy that challenged both liability and damages.

On liability, Kenneth developed a defense demonstrating that, while the client owned the vehicle involved in the accident, liability could only be established if plaintiffs proved negligent entrustment. The defense maintained that plaintiffs could not meet that burden and presented a credible theory demonstrating why liability could not attach to the client.

The defense also mounted a comprehensive challenge to plaintiffs' damages, disputing both the causation and extent of the alleged injuries.
