Whitney Burkett concentrates her practice on defending complex personal injury and catastrophic loss cases. As a seasoned litigator, she regularly manages litigation from inception through trial, including discovery, motion practice and trial preparation. Her background includes defending medical and dental negligence, construction, transportation, premises liability and products liability claims, as well as counseling clients on risk management and litigation strategy. Whitney has a strong track record of success when it comes to identifying cases which should be resolved before trial versus those which are ripe for presentation to a jury. She has counseled clients through the process of a variety of settlement negotiations
Prior to joining the firm, Whitney practiced at a Chicago-based litigation firm where she handled medical malpractice, long-term care and catastrophic injury actions across all phases of litigation. She previously worked at medical negligence, products liability and personal injury defense firms, where she developed global case strategies, prepared and defended expert witnesses, directed trial teams and supervised associates in multi-jurisdictional matters. Whitney has defended clients in state and federal courts across multiple jurisdictions and has taken or defended more than 100 depositions of fact, medical and expert witnesses.
Whitney earned her J.D. from DePaul University College of Law, where she participated in the “Law in London” study abroad program through the University of Syracuse School of Law. She holds a B.S. in psychology with minors in business and history from Tulane University.
Whitney spends her free time in Chicago hosting dinners, at the occasional drive-in movie, rooting for Tennessee Volunteers football, or enjoying the latest sensational crime documentary. She is always planning her next visit to New Orleans, her adopted second “hometown.”

Representative Matters
- Resolved a medical malpractice claim involving alleged quadriplegia in the Circuit Court of Clark County, Nevada. The matter settled during jury selection following extensive pre-trial motion practice and thorough client preparation.
- Represented multiple pediatric emergency physicians in Kansas state court trial where plaintiff alleged failure to diagnose infection resulting in sepsis. Case settled for less than 40% of Plaintiff’s initial demand during trial due to thorough witness training regarding reptile tactics and resulting elevation in performance from deposition.
- Settled product liability claim for alleged negligent design of bicycle below the cost of plaintiff’s claimed treatment due to persistent investigation of and questioning during deposition related to Plaintiff’s activities as well as detailed questioning of Plaintiff’s experts which resulted in deconstruction of Plaintiff’s claims
- Prepared and presented multiple mock trial presentations in catastrophic injury cases in various jurisdictions across the country
