Kerry Lynn Rhoads secured a defense victory for a client on a case involving a dog bite that occurred on a client's property in 2017.
The bite allegedly resulted in surgery to the plaintiff's upper extremity with the plaintiff sustaining both economic and non-economic losses in excess of $100,000.
Pointed discovery by Kerry confirmed that the plaintiff, a sales representative for a home improvement company, exceeded the scope of any alleged permission to be on the defendant's property and thus was deemed a trespasser by the trial court. As a result, she obtained summary disposition of a presumed strict liability claim.
