Michigan Lawyers Weekly published an article by Attorneys John Sechler and Christopher Best on the impact of the recent Michigan Supreme Court ruling on fraud during litigation as grounds for insurance claim denials. In the article, the authors discuss the importance of honesty and integrity throughout the claims process with the MAIPF. They also provide further insight on the ruling of the Michigan Supreme Court that a plaintiff’s fraud and/or misrepresentations extend beyond the claims process and continues into, and throughout, the litigation process.
"The opinion encourages honesty and integrity throughout the claims process, as opposed to rewarding bad behavior when a claim is filed with the MAIPF. Moreover, the ruling of the Michigan Supreme Court clarifies that a plaintiff’s fraud and/or misrepresentations extend beyond the claims process and continues into, and throughout, the litigation process," they say.
