Segal McCambridge Prevails on Summary Judgment in $3.27 Million Condominium Assessment Dispute

Segal McCambridge’s team, led by Shareholder Benjamin Nellans and Senior Associate Masood Ali, successfully secured summary judgment in a multi-million-dollar breach of contract and breach of fiduciary duty case involving disputed condominium special assessments totaling $3,274,500.

The plaintiffs, a group of unit owners, alleged that the condominium association’s board of directors improperly imposed two special assessments and sought seven figures in monetary damages. In addition to their damages claims, plaintiffs pursued declaratory relief that would have impeded our clients’ business operations and exposed them to hundreds of thousands of dollars in additional losses.

The case had been pending for nearly five years and involved hard-fought litigation. Despite operating in a jurisdiction widely regarded as plaintiff-friendly, the team demonstrated that plaintiffs’ claims lacked legal and factual support, resulting in a complete victory at the summary judgment stage.

Masood personally argued the motion for summary judgment and navigated several complex procedural and substantive challenges throughout the life of the case, helping bring this long-running matter to a successful resolution.
