Segal McCambridge Team Prevails in Construction Zone Injury Case

Segal McCambridge secured a defense verdict in a contested liability and damages case following a two-week jury trial in Michigan. Shareholder Kenneth Williams led the trial team alongside James McCoy of the firm’s Michigan office.

 

The case stemmed from a rear-end collision in a construction zone. Both vehicles were totaled.   Plaintiff had been involved in other accidents both before and after the at issue event.  Plaintiff had a complex medical history but alleged that this accident made all of her physical conditions worse.  Plaintiff alleged injuries to both shoulders, neck, back, foot and ankle, in addition to emotional injuries and trauma. She sought damages for ongoing impairment and pain and suffering. 

 

The plaintiff and their experts claimed that the subject accident was the sole proximate cause of their injuries and limitations. The defense successfully argued that the plaintiff’s claims did not meet Michigan’s serious impairment threshold, a requirement for recovery under the applicable state law.

 

Despite concluding that the plaintiff was injured and that the defendant was negligent, the jury determined that the alleged injuries did not rise to the level of a serious impairment of an important body function under Michigan law.
