On Friday, March 6, 2020, Christian H. Gannon, Edward J. McCambridge and Michael J. McKeown successfully defended a client in an asbestos exposure case in the New York State Supreme Court.
The estate of Ira Epstein claimed that, in the summer of 1970, Mr. Epstein worked at the World Trade Center where he was exposed to asbestos dust from joint compounds and floor tiles. Mr. Epstein developed mesothelioma, resulting in his eventual death in 2017. Alleging his mesothelioma was cause by negligence on the part of the defendants, the plaintiff sought $15 million in damages from the Port Authority of New York and New Jersey who owned the World Trade Center and Tishman Realty and Construction Co. who was contracted to construct the buildings.
Following a three-month trial, the jury delivered a unanimous verdict in favor of the defense and awarded the plaintiff no damages after Segal McCambridge attorneys successfully argued that Mr. Epstein never worked at the World trade Center. The jury found that the plaintiff was not exposed to asbestos at the World Trade Center based on construction documentation and depositions of former employees presented by the attorneys of Segal McCambridge.
