The Current State of Transportation Litigation: Incorporation of AI and Autonomous Driving While Preserving Jobs, Published in The Legal Intelligencer

In the article “The Current State of Transportation Litigation: Incorporation of AI and Autonomous Driving While Preserving Jobs” published 6/26 in The Legal Intelligencer, Segal McCambridge Shareholder Jeffrey Marchese discusses how technology advances from AI tools to autonomous systems will help counter nuclear verdicts as the transportation industry also considers how it will evolve and preserve jobs to create a sustainable future where workers and tech advance the sector. When faced with litigation claims, the transportation industry can show how AI tools and data reinforced safety measures.

“These systems can then be shown as part of a company’s due diligence to decrease vehicle accidents,” Marchese notes. “When litigation arises, these AI systems have critical event data logs that can be used as immutable digital evidence.”

Digital experts will be crucial as key witnesses to explain what the AI data means and how the facts were preserved, eliminating some of the emotional drama that can be present in courtrooms. As the transportation industry further improves safety systems and vehicle efficiency with AI, there will be opportunities for jobs associated with autonomous vehicle and AI systems.

“The best approaches to preserve jobs while incorporating new and current technologies combine education, policies, proper planning, and a worker-first design philosophy to look out for our workers,” Marchese explains. “New jobs will also emerge in the AI space, including maintenance, cybersecurity, data labeling, and vehicle diagnostics – and many current transportation workers can transition into some of these roles with appropriate training.”
