David Madariaga concentrates his practice on construction and construction defect litigation, professional liability litigation and business transactional work.  He also has experience litigating premises and products liability, habitation, insurance coverage, and transportation matters. With more than 30 years of litigation experience, he has represented insurers, businesses, contractors and design and construction professionals in complex disputes throughout California and Nevada. David has extensive experience handling construction defect claims, construction accident litigation, premises liability matters, professional liability claims involving home inspectors and trucking claims. He also advises clients on insurance coverage issues, risk management strategies and claims handling practices.

Prior to joining the firm, David served as managing partner, and lead trial counsel, of a California-based insurance defense firm, where he led the firm’s litigation department and supervised attorneys and support staff in the development and execution of litigation strategy. In addition to his litigation practice, he managed a third-party administrator program for a general liability insurer, overseeing claims handling operations across multiple states, issuing coverage position letters, supervising defense counsel and assisting with policy development, regulatory matters and reinsurance audits. Earlier in his career, David handled insurance coverage, environmental and toxic tort litigation, serving as coverage counsel in large construction defect matters and representing clients in coverage disputes.

David is an author and speaker on risk management, report writing and legal issues affecting the home inspection industry. He has presented seminars and published articles for organizations including the American Society of Home Inspectors (ASHI), the California Real Estate Inspection Association (CREIA) and other industry groups.  He has also taught seminars for claims adjusters on construction defect litigation and reservation of rights letters that provided CL credits for the adjusters

David earned his J.D. from Loyola Law School, Los Angeles and holds a B.A. in political science from the University of California, Los Angeles. He has also completed advanced training through the Straus Institute for Dispute Resolution at Pepperdine University.

David lives in West Los Angeles with his wife, two children, and their dog and two cats.  He likes cooking, reading, movies, biking to the beach and spending time with family and friends.

Representative Matters

  • Alleged medical malpractice claim resulting in quadriplegia was filed in the Circuit Court of Clark County, Nevada. The case settled during jury selection after the plaintiff buckled due to aggressive pre-trial motion practice and client preparation.
