Segal McCambridge Secures Legal Victory: Equestrian Defendants Cleared in Florida Wrongful Death Case

Segal McCambridge, led by Shareholder, Nicholas Richardson, and Associate Kimbrell Hines, secured a significant victory in a wrongful death case applying Florida's Equine Liability Act, resulting in a dismissal of liability on behalf of the Firm’s client.

Relying on Florida's Equine Liability Act, Nicholas and Kimbrell filed a Motion for Summary Judgment on behalf of our clients, arguing that our clients were shielded from liability for injuries resulting from the inherent risks of equine activities. Following lengthy briefing and arguments, the court agreed.

This case underscores the legislative intent behind Florida's Equine Liability Act to limit liability for inherent risks associated with equine activities, and the court's decision affirmed its application to the facts presented, precluding the Plaintiff from seeking civil redress for the Plaintiff's death. This case is another example where targeted discovery, depositions and witness preparation can lead to favorable outcomes for the client in high exposure litigation.
