Segal McCambridge Wins Resounding Defense Verdict in Michigan’s Oakland County Circuit Court

The firm obtained a complete defense verdict in a third-party automobile negligence case tried in the Oakland County Circuit Court. The plaintiff alleged that our client negligently operated her vehicle in a manner that caused the accident and resulted in severe and ongoing injuries for the plaintiff. In the five-day trial, James McCoy and Kenneth (Ken) Williams demonstrated that the plaintiff was not only at fault for the accident but that the injuries claimed as a result of the accident were all pre-existing medical conditions that the plaintiff was already undergoing treatment for.

During the trial, several medical experts were called to show that the injuries resulted from the accident. However, during cross-examination of these witnesses, James was able to elicit testimony proving that none of the plaintiff's testifying doctors had ever reviewed the plaintiff's pre-accident medical records and, further, that all of the plaintiff's doctors who testified at trial that the injuries arose from the accident were unaware at the time they treated the plaintiff that the plaintiff was already treating for these same conditions prior to the accident.

Ken concluded the trial with closing arguments that presented complex medical information in a manner that was convincing and easily digestible for the jury. He pieced together all of the evidence presented so that the jury could evaluate the complete picture, highlighting the important holes conspicuously omitted in the plaintiff's trial arguments. He outlined how the defense had filled in the missing information to allow the jury to make a decision based on all the facts.

After several hours of deliberation, the jury returned a resounding finding in favor of the defense. Ultimately, the jury was persuaded that the plaintiff did not suffer any injuries as a result of the motor vehicle accident. As a result, no damages against the defendant were awarded in favor of the plaintiff.
